GameBrain for WordPress — Terms of Service
These Terms of Service ("Terms") govern your use of the GameBrain for WordPress plugin ("the Plugin") and the GameBrain data and API access it provides ("the Service"). By connecting the Plugin to GameBrain ("we," "our," or "us"), you agree to these Terms. They supplement the general GameBrain Terms of Service; where the two differ in respect of the Plugin, these Terms apply. Data handling is described in our GameBrain for WordPress Privacy Policy.
1. The Plugin and the Service
The Plugin is free, open-source software licensed under the GNU General Public License, version 2 or later. These Terms do not restrict your rights in the Plugin's source code under that license. They govern your use of the Service — the game data GameBrain provides to the Plugin through its API, and the account that authorizes it — which is separate from the Plugin's code license.
2. Account and Redisplay Rights
Connecting the Plugin creates a free, site-scoped GameBrain account for your website. While the account is active, we grant you a non-exclusive, revocable right to display GameBrain-provided game data on that website through the Plugin's blocks, shortcode, and widget. This right is limited to display through the Plugin. The data is served subject to display limits ("tease, don't replace") enforced by the API; you may not attempt to circumvent these limits, bulk-extract, resell, or redistribute the data outside the Plugin's intended display.
3. Attribution
Each block can optionally display a small "View on GameBrain" attribution link. Attribution is off by default; you may turn it on or off at any time from the Plugin's settings, and your choice never affects your right to display game data through the Plugin's other features. If you choose to enable attribution, you agree not to modify, hide, obscure, or apply a "nofollow" attribute to the link while it is shown.
4. Store and Affiliate Links
"Where to buy" blocks may display links to external stores. Some of these are affiliate links that contain a GameBrain referral code, from which GameBrain — not you, the site owner — may earn a commission on referred purchases. The Plugin marks such links and shows a disclosure where applicable. Installing the Plugin does not create any commercial or affiliate relationship between you and those stores, and you should not represent that it does.
5. Data Accuracy and Availability
Game data, scores, review summaries, prices, and store offers are aggregated from third-party sources and provided "as is," without warranty of accuracy, completeness, or timeliness. Prices and offers in particular may change and may be out of date. We may modify, rate-limit, or discontinue the Service or API at any time. We are not liable for any loss arising from your use of, or inability to use, the Service.
6. Intellectual Property
All game-related information belongs to the respective game creators, publishers, and platforms; GameBrain aggregates publicly available information and provides the search, recommendation, and delivery service around it. The Plugin's source code is licensed under the GPL as noted above; the GameBrain name and logo remain our property and their use is limited to the attribution the Plugin renders.
7. Acceptable Use
You agree not to use the Service to overload, probe, or abuse the API; to circumvent display limits or account scoping; to misrepresent the source of the data; or to use the Service in a manner that is unlawful or infringes the rights of others.
8. Suspension and Termination
We may suspend or terminate your account and API access at any time, without prior notice, for breach of these Terms — including tampering with an enabled attribution link or circumvention of display limits. You may end your use of the Service at any time by disconnecting or uninstalling the Plugin, which also requests deletion of your account.
9. Indemnification
You agree to indemnify and hold harmless GameBrain and its founders from any claim, demand, loss, or liability, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the Service — including tampering with an enabled attribution link, circumvention of display limits, or misrepresentation of the source of the data.
10. No Affiliation with WordPress
The Plugin is distributed through the WordPress.org plugin directory and licensed under the GPL, but GameBrain is not affiliated with, endorsed by, or sponsored by the WordPress Foundation, Automattic, or the WordPress.org project. "WordPress" is a trademark of the WordPress Foundation. Your download and use of the Plugin through WordPress.org is also subject to the terms and guidelines of that platform.
11. Governing Law and Disputes
These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict-of-law rules, and any dispute arising out of or relating to these Terms or the Service that cannot be resolved amicably shall be subject to the jurisdiction of the competent courts of Germany. Nothing in this section deprives you of any mandatory consumer protections you may be entitled to under the laws of your country of residence.
12. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision is not a waiver of that right. You may not assign or transfer your rights under these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or transfer of assets. These Terms, together with the general GameBrain Terms of Service and the GameBrain for WordPress Privacy Policy, constitute the entire agreement between you and GameBrain regarding the Service.
13. Changes to These Terms
We may update these Terms from time to time. Your continued use of the Service after any change constitutes acceptance of the updated Terms. We encourage you to review them periodically.
